Haitians are able to apply for Temporary Protected Status (TPS). Boston is home to many Haitians and I have many friends with relatives there. My heart goes out to them and the whole Nation.
TPS was recently extended and the new expiration date is January 22, 2013. Re-registration is was closed as of August 22, 2011, however:
If you do not currently have TPS, you may apply from May 19, 2011 through Nov. 15, 2011.
Applicants will need to pay fees for the I-821, the biometrics, and the I-765 if a work authorization is desired and the I-131 if advance parole (travel permission) is sought. Applicants may apply for fee waivers.
To prove nationality one can use a passport (an expired one is acceptable) or birth certificates. USCIS has indicated that secondary evidence may be considered since these can be difficult to come by.
Some waivers of inadmissibility are available on humanitarian grounds. Note: this will not cure inadmissibility under other areas of the law and another I-601 will have to be filed if someone is, for example, at a later date adjusting status through an immediate relative.
